Fijian employment law

Every team member placed through Our Pacific Office is employed in full compliance with the Employment Relations Act of Fiji. We coordinate contracts, termination procedures, statutory entitlements, and all in-country obligations. This safeguards your business from potential liabilities in a jurisdiction where specialised expertise is essential.

Data security and confidentiality

Your team member works from a secure, managed workstation in our Nadi office. We can implement data access restrictions, VPN requirements, restricted browsing policies, two-factor authentication, and other controls tailored to your security standards. Confidentiality agreements and NDAs are standard inclusions in all employment documentation.

Australian Privacy Act

If your offshore team handles personal information about Australian customers or individuals, the Australian Privacy Act 1988 may apply to your business. Our arrangements are structured to support compliance with these obligations, and we can collaborate with you to review data handling practices.

IP ownership and contracts

All employment agreements are designed to assign intellectual property rights to your business. Any work product created by your team member as part of their role belongs to you. Our contracts are regularly reviewed to ensure they remain current, well-structured, and enforceable.

IT infrastructure and security

Our office operates on a managed IT infrastructure overseen by our in-house IT Manager. Workstations are configured to your specifications, network access is tightly controlled, and robust technical security measures are in place. We can align our IT security posture with your business policies as needed.

Regulatory monitoring

Fijian employment laws and tax obligations evolve over time. We actively monitor these changes and update our employment structures to ensure ongoing compliance. Your offshore team remains aligned with local regulations without requiring you to track developments in a foreign jurisdiction.

What businesses want to know before they start.

Do I need to establish a company in Fiji?

No. Your team member is employed through Our Pacific Office. You don't need to register any entity in Fiji, engage with the Fijian regulatory environment or manage any in-country obligations directly. We are the employer of record and we carry those responsibilities.

Who is legally responsible for the employment relationship?

Our Pacific Office holds the employment relationship in Fiji. We manage payroll, statutory obligations and compliance with Fijian employment law. Your relationship is with us as a service provider, not with a separate Fijian entity you would otherwise need to establish and manage.

How is data security managed when someone is working in Fiji?

Your team member works from our managed office environment in Nadi. We configure workstations to your requirements, control network access and implement technical security measures that match your IT security policy. Our IT Manager handles setup and ongoing management. The security posture is comparable to any high-level office environment.

Can our team member sign an NDA?

Yes. Confidentiality agreements are incorporated into employment documentation as standard for every placement. Additional requirements specific to your business, including more detailed NDAs, can be accommodated as part of the employment agreement.

Does the Australian Privacy Act apply to our offshore arrangement?

It may, depending on how your business collects, stores and handles personal information about Australian individuals. The obligation sits with your business as the entity collecting or using that information, regardless of where it's processed. We structure our arrangements to support compliance and can work through the relevant considerations with you.

What happens when Fijian employment law changes?

We monitor regulatory changes and update our employment structures, contracts and payroll processes accordingly. That is part of our ongoing service. You are not responsible for staying current with Fijian law — we are. If a change affects your arrangement, we'll let you know what it means and how we've addressed it.
